Tree Damage
This is one of the most asked questions we get and especially after every wind storm.
Who is responsible for the damage the tree causes?
My homeowner’s or car insurance?
My neighbors home or auto insurance?
The person that owns the tree?
There is a very simple guideline to this. Whoever owns the damaged property is whose insurance is responsible to pay.
It does not matter who owns the tree and if your home or property is damaged then your homeowner’s insurance will pay.
If the tree falls on your vehicle then your auto insurance will pay as long as you have the coverage. For tree damage or damage from falling objects falls under your comprehensive coverage.
There is one stipulation that may change this guide. It depends if that tree is dead or neglected.
Dead & Neglected Tree
If your neighbor has a dead and neglected tree you must bring it to their attention that it is a concern for you. We suggest doing this with a certified letter so there is proof it was received.
By putting your neighbor on notice, it makes them liable in the event we have a wind storm and the dead tree falls on and damages your property.
It will allow you or your insurance company to collect from their liability coverage.
